These Terms and Conditions set out the basis on which Rubbish Removal Ilford provides rubbish removal, waste collection and associated services to you. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions:
Client, you or your means the person, business or organisation requesting our services.
Company, we, us or our means Rubbish Removal Ilford, the service provider.
Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal or related services provided by us.
Booking means a confirmed request by you for services, whether made by phone, email, online form or any other communication method accepted by us.
Waste means any items, materials, rubbish, junk or refuse presented by you for collection and disposal as part of the services.
2. Scope of Services
We provide domestic, commercial and garden rubbish removal and waste collection services, including but not limited to house clearances, office clearances, one-off collections and regular waste collection support.
The exact scope of the services for each booking will be as agreed between you and us at the time of booking, and may include an estimated or fixed price based on the description, volume and nature of the waste to be collected.
We are not responsible for any tasks outside the agreed scope, including building work, removals of fixtures, structural alterations or specialised hazardous waste handling unless expressly confirmed in writing.
3. Booking Process
You may request a booking by contacting us via our accepted communication channels. We may ask for details including your name, address, contact details, access information, type and estimated volume of waste, and any special requirements.
A booking will be considered confirmed only when we have accepted your request and provided a date, time window and price estimate or quotation. We may confirm bookings verbally, by email or by other written confirmation.
It is your responsibility to ensure that all information provided at the time of booking is accurate and complete. If the information is incorrect or incomplete, we may adjust the price, alter the services or refuse to carry out work on arrival.
Where we provide a quote based on photographs, descriptions or estimated waste volumes, the final price may be adjusted on site if the actual waste volume, weight or nature differs from that originally described.
4. Access and Site Conditions
You must ensure that we have safe and reasonable access to the property, premises or site where the waste is to be collected. This includes access for vehicles, parking arrangements and unobstructed access to the waste.
You are responsible for obtaining any necessary parking permissions or permits and for paying any related charges, unless otherwise agreed in advance.
If access is restricted, unsafe or significantly different from that described at the time of booking, we may:
Adjust the price to reflect additional time, labour or equipment required.
Limit the amount of waste collected.
Cancel the service and apply a call-out or cancellation fee as set out in these terms.
5. Waste Type and Restrictions
You must accurately describe the type of waste to be collected. Certain items are restricted or may incur additional charges, including but not limited to:
Hazardous waste such as chemicals, solvents, paints, oils, asbestos, medical waste, gas bottles and clinical waste.
Electrical and electronic equipment that requires special disposal processes.
Large or unusually heavy items requiring specialised handling or equipment.
If hazardous, prohibited or undeclared items are discovered during collection, we may refuse to remove such items, charge additional fees for handling, or terminate the service. You are responsible for any costs, fines or liabilities arising from concealed hazardous or prohibited waste that you present for collection.
6. Pricing and Quotations
Prices are generally based on the volume, weight and nature of the waste, access conditions and the time required to complete the service. We may provide fixed or estimated quotes.
Where a fixed quote has been provided and the scope of work and waste type match the information given at the time of booking, the price will not change.
Where a quote is based on an estimate or on information provided remotely, we reserve the right to revise the price on arrival if the actual waste volume, access conditions or waste type differ materially from what was described.
All prices will be provided in pounds sterling and may be subject to applicable taxes where required by law.
7. Payments
Payment terms will be confirmed at the time of booking. We generally require payment on completion of the service, unless alternative arrangements have been agreed in advance for account or commercial clients.
We may accept payment by cash, debit card, credit card, bank transfer or other methods as notified to you. We reserve the right to refuse cheques or certain payment types.
Where payment is not made on completion, any credit terms will be strictly applied. If payment is not received by the due date, we may charge interest on the overdue amount at the statutory rate and may suspend further services until full payment is received.
You are responsible for all charges incurred for services provided, including any additional charges arising from inaccurate bookings, waiting time, restricted access or undeclared waste types.
8. Cancellations and Amendments
You may cancel or amend a booking by giving us reasonable notice via our accepted communication channels.
If you cancel more than 24 hours before the scheduled service time, no cancellation fee will normally apply unless we have incurred specific costs on your behalf.
If you cancel less than 24 hours before the scheduled service time, we may charge a cancellation fee to cover our costs and loss of opportunity.
If our team arrives at the agreed time and is unable to carry out the work due to your fault, including absence, lack of access or refusal of service, we may treat this as a late cancellation and charge a call-out or cancellation fee.
We reserve the right to cancel or reschedule bookings for reasons including adverse weather, vehicle breakdown, staff illness, safety concerns, access issues or other circumstances beyond our reasonable control. In such cases, we will endeavour to reschedule the service at a mutually convenient time.
9. Service Delivery and Completion
We will use reasonable care and skill in providing the services and will aim to complete collections within the agreed time window, subject to traffic, access and operational conditions.
On completion of the services, you may be asked to confirm that the work has been carried out to your satisfaction. Any issues or concerns should be raised immediately with our team on site or with our office as soon as possible.
Once we have removed the agreed waste from the site, responsibility for that waste transfers to us and we will manage its transportation, transfer and disposal in accordance with applicable waste regulations.
10. Waste Regulations and Environmental Compliance
We operate in accordance with applicable UK waste management, environmental and duty of care regulations. We will transport and dispose of collected waste only at licensed facilities or through authorised partners.
By using our services, you confirm that you have the right to dispose of the waste being presented and that you are not in breach of any tenancy, ownership or third-party rights in relation to the items.
We may provide a waste transfer note or equivalent documentation where required by law or on request. You agree to retain any such documentation for your records and compliance obligations.
11. Liability and Limitations
We will exercise reasonable care to avoid damage to your property while performing the services. However, minor scuffs, marks and wear that may reasonably occur during the removal and carrying of bulky items through narrow or restricted spaces will not be considered damage for which we are liable.
Our liability for any proven loss or damage caused by our negligence will be limited to the reasonable cost of repair or replacement of the affected property, up to a maximum aggregate amount equal to the total price paid for the specific service during which the incident occurred.
We will not be liable for:
Any indirect or consequential loss, including loss of profit, revenue, business or opportunity.
Loss or damage arising from inaccurate information provided by you.
Loss or damage arising from access routes or areas that you requested us to use despite being unsuitable or unsafe.
Loss of items that you intended to keep but which were not clearly separated from the waste or were presented to us as waste.
Nothing in these terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
12. Your Responsibilities
You agree to:
Provide accurate information about the waste and site conditions.
Ensure safe and suitable access to the collection area.
Secure and remove any personal or valuable items that you do not intend to dispose of before our arrival.
Comply with any reasonable instructions given by our team to ensure safety and efficient delivery of the services.
Not request or permit our staff to undertake any activity that is unsafe, unlawful or outside the agreed scope of services.
13. Insurance
We maintain appropriate insurance cover for our activities, including public liability insurance, subject to the terms, exclusions and limits of our policy. Details of our insurance can be provided on request.
14. Complaints and Disputes
If you are not satisfied with the services provided, you should contact us as soon as possible with full details of the issue. We will investigate and aim to resolve complaints in a fair and timely manner.
When raising a complaint, you should provide your name, contact details, service date, address and a clear description of the problem. We may request photographs or additional information to assess the issue.
Nothing in this section affects your statutory rights under consumer protection legislation where applicable.
15. Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events or circumstances beyond our reasonable control. These may include extreme weather, natural disasters, accidents, strikes, transport disruptions, acts of government, or other events that prevent or significantly hinder our operations.
16. Data Protection and Privacy
We will handle any personal information you provide in connection with bookings and services in accordance with applicable data protection laws in the UK. We will use your details to manage your booking, deliver services, process payments, respond to enquiries and for related administrative purposes.
We may retain records of your bookings and communications for a reasonable period to comply with legal and accounting requirements, and to improve our services.
17. Changes to These Terms
We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified to you. The version of the terms that applies to your booking will be the version in force at the time you made the booking.
18. Severability
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
19. Governing Law and Jurisdiction
These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales.
Any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in your local courts.
By placing a booking or using our rubbish removal and waste collection services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
